Internet Intellectual Property Institute Successfully Held The First “Internet Domain Name Dispute Resolution Training Course”

Internet domain name has become an identity of brands for individuals, enterprises, and organizations on the Internet. Its importance has increased dramatically. Last year, the number of global domain name registrations has reached 340 million, far exceeding the amount of trademark registration. However, this has also triggered a substantial increase of disputes over trademark rights and domain names, concerning about the malicious use of Internet domain names online trademark infringement, and trademark dilution.  As of December 2017, the number of global disputes has exceeded 39,000, involving more than 73,000 domain names, and the lawyer fees involved are estimated to exceed US$250 million.

 

In this context, the Internet Intellectual Property Institute in collaboration with the Hong Kong International Arbitration Centre (HKIAC), successfully organized the “Internet Domain Name Dispute Resolution Practice Training  Seminar” at the Guangzhou Conrad Hotel on this year’s World Intellectual Property Day (April 26, 2018). It serves as a platform for professional intellectual property lawyers to fully grasp various domain name dispute resolution policies and ICANN rights protection mechanisms, and plays a positive role in the protection of global brands in Internet domain names.

 

The Guangzhou Training Seminar has great significance and practicality. It has been listed as one of the World Intellectual Property Day Events by the World Intellectual Property Organization (WIPO). In addition, this training has been recognized by the Asian Domain Name Dispute Resolution Center (ADNDRC) as its accredited Domain Name Dispute Resolution Training Courses for domain name panelists.

 

The training was attended by nearly 50 senior intellectual property lawyers and in-house counsel from famous companies from Beijing, Shanghai, Shenzhen, Chengdu, and Guangzhou. Dr. Shengjie CHEN, Secretary-General of the Guangdong Intellectual Property Protection Association, and opened by Dr. Jianchuan ZHANG, Director of the ICANN Beijing Center kicked start the training by delivering opening remarks and keynote speech.

Dr. Jianchuan ZHANG, Director of the ICANN Beijing Center is at the keynote speech.


Subsequently, Mr. Dennis CAI, the co-founder of IIPI, and Ms. Carrie SHU, the Alternative Dispute Resolution Counsel of Hong Kong Arbitration Center, gave a detailed introduction and practical process guidance on UDPR and various domain name dispute resolution policies.  This is followed by two leading IP lawyers, Mr. Qiang GAO and Mr. Eugene LOW who shared their experience in the court procedures for domain name disputes and discussed the substantial issues in domain name dispute resolution.

In the last training session, Mr. Cai  introduced the Internet DotTrademark’s innovative registration system and its pre-registration trademark rights verification mechanism from an academic perspective. He pointed out that in the current situation  where counterfeit domain names can be easily registered and domain name disputes continue to increase, more and more companies around the world have registered and been using  verified top-level domains to provide fully trusted online portals for their customers and mitigate the legal risks arising out from online infringements.

 

During the training session, participants presented their own unique views on a number of Internet IP issues, and positively evaluated this training session. Mr. Frank ZHANG  Senior Counsel of Tencent Company shared Tencent's strategy of using domain name dispute resolution and verified domains as effective tools to tackle domain name infringement and protect  their trademark rights online .
