Notification of Launch of New Regime and Pricing for Dot Trademark Registration and Services

Dear registrars and resellers,

  

To facilitate trademark owners to enhance denotation, application, and protection of their trademark rights through the Chinese verified Top Level Domain (TLD) “. 商标”  (“Dot Trademark”) on the Internet, Dot Trademark TLD Holding Company Limited (“the Registry”) has published a registration and service regime with new naming methods and pricing (the “Regime”) which will take effect from 1 January 2017 onwards. 


The Regime features four trademark-right-based naming methods and protection services. The new naming methods incorporate territorial and classification information, which enable trademark owners to reflect their trademark rights in a more accurate and systematic manner. The new protection services based on one’s verified trademark classification (services and goods) information can effectively prevent the occurrence of any infringing registrations and use of Dot Trademark. Meanwhile, a new fee schedule setting out prices for different types of Dot Trademark registrations and services will be applicable on the above effective date of the new Regime. 


Dot Trademark registration applications received before 1 January 2017 will be processed under the currently effective registration rules and pricing. For registration applications received on or after 1 January 2017, they will be handled under the new Regime and pricing. New Naming Methods and Pricing of Dot Trademark Registration and Service

Note:

l   Among the above four categories of naming methods, trademark owners may choose one or multiple categories in registering their Dot Trademarks according to the scope of their trademark rights (i.e. the classification(s) and designated place(s) of their registered trademark(s) and rights protection needs.

l   To activate the protection services under categories A and B, Dot Trademark registrants under Categories A and B are required to specify the goods/services of the relevant classification under the trademark certificate which has been verified by the Registry. 

l   Registrants under categories A and B may apply for extending the protection service to cover extra trademark registration classification(s) with up to 10 goods/services under each classification, and/or extra goods/services under the same trademark registration classification by submitting relevant trademark rights supporting documents together with addition annual fees (i.e. CNY 1,200 for one extra classification, and CNY 200 for one extra good/service under one verified classification.  

l   For registered Dot Trademarks under categories C and D, the Registry offers protection services based on verified information of relevant trademark’s designated and classification, and prevent corresponding Dot Trademarks in the form of “designated place + trademark name + goods/service“.商标”from being registered by third parties. 

l   Upon successful registration of a Dot Trademark based on any of the above naming methods, the Registrant may add non-trademark registration information or generic terms as an addition to the registered Dot Trademark to create a new registration, provided that the generic terms included   meets the following conditions:

    (1) The additional generic term is directly relates to the trademark;

    (2) If the additional generic term requires specific qualifications, the applicant must prove its eligibility under  the applicable laws or industry customs of the designated place of the relevant trademark proof (e.g. trademark rights certificate) ;

    (3) Must not cause any confusion to consumers and potential consumers in identifying and distinguishing goods/services

l   If there are any discrepancies between the Chinese and English version, the Chinese version shall prevail.
